TERMS AND CONDITIONS
These Terms and Conditions form part of the contract between the person(s) who book and pay for the property rental (hereinafter called the “Guest”) and the property owners who have the legal authority to rent out the property (hereinafter called the “Owner”). Name of the property is “Villa Ohana”, and is situated in 20 Yildiz Sk, Kalkan, Kas, Antalya 07960.
The contract (hereinafter call the “Agreement”) between the Guest and the Owner exists when the Owner issues a booking confirmation email as a response to the Guest’s booking request, and is in receipt of the Guest’s initial payment.
Terms of Payment: A non-refundable deposit of 30% of the total cost is required to secure booking, with the remaining balance payable 10 weeks prior to check-in date. A refundable damage deposit of 300£ is payable with the outstanding balance. This is required to cover the cost of any damages or breakages. The damage deposit will be refunded to the Guest within 10 working days after the check-out date, less any damage costs. For bookings within 10 weeks from check-in date, full payment must be made with the booking.
All arrangements are made subject to the following Terms and Conditions.
Upon booking confirmation, no changes can be made in the rental price stated on the Agreement. Price on the Agreement includes the use of Villa Ohana, including utilities and facilities which are advertised in the property description as being available at no extra cost. If staying more than one week, the beddings and bath towels are changed weekly. Pool towels are provided one per person per rental duration. The rental price does not include security/damage deposits, en-route hotels, sea crossings, flights, car hire, transfers, car parking and holiday travel insurance.
Upon receipt of the booking confirmation from the Owner, the Guest must check the details and notify the Owner of any mistakes/errors made by the Owner as soon as possible or within three days; no changes can be made to the booking after this time.
If the Guest wishes to change the dates on the booking confirmation, the change request must be done in writing. Owner will then accommodate the change request only if it is possible based on the availability calendar.
If the Guest wishes to cancel the booking altogether, the cancellation request will be done in writing, which will become effective on the delivery date of the cancellation request. All cancellations are subject to a charge payable by the Guest as detailed below.

If the Guest has failed to pay the outstanding balance on time, the Owner can cancel the booking as a result, with no refund of the deposit.
If the Guest ended their stay earlier than as stated in the Agreement, the Owner is not obligated to give a refund for the unused portion of the agreed upon dates.
In the very unlikely event, Villa Ohana ceases to be available as booked, and the Owner is unable to offer the Guest acceptable alternative accommodation, the Owner will refund the Guest all the monies paid (including the deposit) and shall be under no other liability.
No liability can be accepted by the Owner when the Agreement is affected by force majeure. In the context of these terms and conditions 'force majeure' is any event that the Owner could not, even with due care, foresee or avoid. These events include, but are not limited to: war, threat of war, riot, civil commotion or strife, hostilities, industrial dispute, natural disasters, acts of god, terrorist activity, threat of terrorist activity, adverse weather conditions, airport closure, government action, changes to Government authorities’ travel advice, technical problems with transportation or any other events beyond the Owner’s control.
All necessary travel insurance coverage must be purchased by the Guest for the protection of the Guest and the rental party.
The Guest can check in to Villa Ohana from 1500 on the day of arrival and must check out by 1100 on the day of departure. This allows time for Villa Ohana to be cleaned in between Guests. These times are set unless prearranged at the time of booking subject to availability and in some cases, at additional cost. There will be instances that the cleaners will be in Villa Ohana during the last hour of the Guest’s occupancy to facilitate a more efficient changeover.
On arrival to Villa Ohana, the Guest will be met by a member of rental property managing staff to hand over the keys, during the normal hours between 1500 and 2100. If this is not possible, the Guest will be provided with a code to the key safe. When departing Villa Ohana, the Guest must leave the keys in the key safe.
Villa Ohana is reserved exclusively for the people confirmed as part of the Guest’s rental party at the time of booking and no other persons are permitted to stay in Villa Ohana unless agreed by the Owner in writing prior to the rental period.
The Guest and the rental party must keep Villa Ohana in the same state of repair and condition as at the commencement of the stay. Villa Ohana must be left in the same state of cleanliness and general order in which it was found. Should any of the equipment or furnishings in Villa Ohana be lost or damaged, the cost to replace or to repair will be deducted from the damage deposit.
The Owner shall not be responsible for the death or personal injury of the Guest or any person named on the Booking Form or other persons at the property. The Owner shall not be liable for any loss, breach or delay due to any cause beyond their reasonable control.
No construction is allowed in Kalkan in the summer season. Construction is only allowed in the non-peak times of the year. If the Guest wishes to make a booking for dates between mid-October and mid-May, it is possible that construction projects may be going on in the area during that period. The Owner will endeavor to inform the Guest of this fact, but is not expected to know about all the building projects in Kalamar. Therefore, the Guest cannot be guaranteed to be unaffected by construction projects.
The Owner is not responsible for noise or disturbance originating beyond the boundaries of Villa Ohana or which is beyond their control.
The Owner cannot be held responsible for the breakdown of mechanical equipment such as pumps, boilers, swimming pool filtration systems etc. The Owner shall find a way to repair the broken equipment at the soonest possible time.
The Owner shall not accept liability for loss of utility services such as power and water supplies. Refunds and compensation would not be payable and cancellation charges would still apply.
Under no circumstances will animals be allowed in Villa Ohana (with the exception of guide dogs used to aid sight or hearing and only with prior arrangement).
All members of the Guest’s rental party agree not to smoke or allow smoking inside Villa Ohana at any time.
Within the Guest’s rental party, parents/guardians are responsible for the supervision of young children and teenagers.
The Guest is expected to secure Villa Ohana at all times and take care of property keys. The cost of replacement keys will be deducted from Guest’s security/damage deposit, if keys are lost during the rental period.
The Guest and the rental party’s personal belongings and vehicles left in Villa Ohana are entirely at their own risk. The Owner shall not accept any liability for any loss or damage to the Guest and the rental party’s personal belongings and vehicles in the duration of the rental period.
The Owner reserves the right to terminate, without notice, the arrangements of the Guest or member of the rental party whose behavior, in the Owner’s opinion, is likely to cause annoyance, distress or danger to neighbors or any third party. Also, if the Guest and the rental party is prevented from travelling because they appear to any person in authority to be unfit to travel, or likely to cause discomfort or disturbance to other customers, the Owner’s responsibility for the accommodations will cease. Full charges will apply and the Owner will be under no obligation to provide a refund, compensation, or any further assistance.
General Data Protection Regulation
PRIVACY POLICY
Russell Price and Anna Irish Price are the owners (hereinafter called the “Owner”) of the website VillaOhanaKalkan.com. This website is a tool to advertise the property (hereinafter called “Villa Ohana”) as a rental property, and facilitates inquiries and bookings in reference to the said property. This privacy policy will explain how the Owner uses and protects personal data collected from the inquirers and guests (hereinafter called the “Guest”) when the Guest uses the Owner’s website to inquire about rates and availability and/or requests for a booking and eventually confirmed by the Owner, based on availability.
The Owner collects the following data:
- Personal identification information of the Guest and the members of the rental party (Name, postal address, email address, phone number, etc.)
- Credit card or debit card numbers and details to pay for the rental.
- Passport details and dates of birth of all the members of the rental party (as required by the local authorities)
- Flight details
- Bank details to refund the damage deposit after the rental period.
- Cookies to collect statistics based on the usage of the Owner’s website, if the Guest agrees to the pop-up Cookies Acknowledgment button.
The Guest directly provides necessary data for the Owner to reply to the inquiries, create a booking and perform the rental services. The Owner collects and processes data when the Guest:
- Inquires about booking Villa Ohana
- Requests to book Villa Ohana
- Makes payments for the Villa Ohana rental
- Requests for the damage deposit to be refunded
- Voluntarily provides feedback on any of the Owner’s website message boards or via email.
- Uses or views the Owner’s website via the Guest’s browser’s cookies (see bottom of this page for explanation of "cookies")
The Owner collects the Guest’s data so that the Owner can:
- Process and manage the Guest’s inquiry and booking. When the Owner processes and manages the Guest’s booking, the Owner may pass on the Guest’s and the rental party’s data to third party as necessary.
The Owner is committed to ensuring that the Guest’s data is secure. In order to prevent unauthorized access or accidental disclosure, the Owner commits to place suitable physical, digital, and managerial procedures to safeguard and secure data collected in relation to the rental inquiry and booking.
The Owner will not store the Guest’s bank details or debit/credit card details used to pay for the rental of Villa Ohana.
The Owner retains the Guest’s data only as long as necessary for tax and insurance purposes or to fulfill legislative requirements.
The Owner would like to make sure the Guest is fully aware of all the data protection rights. Every Guest is entitled to the following:
The right to access – the Guest has the right to request the Owner for copies of his personal data.
The right to rectification – the Guest has the right to request that the Owner corrects any information the Guest believes is inaccurate. The Guest also has the right to request the Owner to complete the information believed to be incomplete.
The right to erasure – the Guest has the right to request that the Owner erases personal data, under certain conditions.
The right to restrict processing – the Guest has the right to request that the Owner restricts the processing of the Guest’s and rental party’s personal data, under certain conditions.
The right to object to processing – the Guest has the right to object to the Owner’s processing of the Guest’s and rental party’s personal data, under certain conditions.
The right to data portability – the Guest has the right to request that the Owner transfers the data that have been collected to another organization, or directly to the Guest, under certain conditions.
If the Guest has any requests or questions about the Owner’s Privacy Policy, the data the Owner holds on the Guest, or the Guest wishes to exercise one of the protection rights, please contact: Anna Irish Price, villaohanakalkan@gmail.com. The Owner promises to respond to the Guest’s request or query within 40 days of receiving the written request. In certain limited circumstances, the Owner is entitled to refuse the request.
This Privacy Policy covers the website VillaOhanaKalkan.com and controlled by the Owner only. Other websites are not covered by this Privacy Policy.
